These Terms & Conditions (the “Conditions”) govern access to and use of the WinToFlight website at wintoflight.com (the “Site”), operated by WinToFlight Ltd, a company registered in England and Wales under company number 17199419, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (“WinToFlight”, “we”).
By creating an account, purchasing a ticket, or otherwise participating in a competition offered on the Site, the user (“you”, the “Participant”) agrees to be fully bound by these Conditions. The specific conditions applicable to each competition (the prize, the entry fee, the number of available tickets, the closing date, etc.) are set out separately on each competition’s page and supplement, without replacing, these general Conditions.
By accessing the Site or participating in a competition, you fully accept to be bound by these Conditions. If you do not agree with these Conditions, you must not use the Site or participate in a competition.
WinToFlight offers skill-based prize competitions within the meaning of section 14 of the Gambling Act 2005. The selection of the winner(s) never relies solely on chance: each Participant must correctly answer a question of skill, judgement or knowledge before their ticket becomes eligible for the prize.
The question set is calibrated to constitute a genuine barrier to entry, rather than a purely formal one, in line with the Gambling Commission’s guidance on section 14(5) of the Gambling Act 2005. WinToFlight is not a lottery operator and is not required to hold a Gambling Commission licence for the competitions offered on the Site, which fall within the exemption applicable to skill-based competitions.
To participate in a competition, you must:
Be at least 18 years of age at the time of participation.
Have full legal capacity to enter into a binding contract.
Provide accurate and complete information.
Not be a director, employee, partner or direct affiliate of WinToFlight Ltd, nor a close family member of such a person.
Participation is open internationally, provided it is lawful in the Participant’s country of residence. It is the Participant’s responsibility to ensure compliance with applicable local laws.
WinToFlight reserves the right to request, at any time, a valid government-issued photo ID, proof of address, or any other information required for identity verification (KYC). Failure to provide the requested documentation may result in forfeiture of the prize.
Participating in a competition requires creating an account with a valid email address and accurate, up-to-date information. Each Participant may hold only one account. Creating multiple accounts in order to circumvent per-person ticket limits constitutes fraud within the meaning of Article 13 of these Conditions and will result in the Participant’s exclusion and cancellation of their tickets, without refund.
The Participant is responsible for keeping their login credentials confidential and for all activity carried out through their account.
Each ticket is sold at the price shown on the relevant competition page, inclusive of any applicable taxes. Prices are displayed in the currency indicated on the competition page; where a Participant pays in another currency, their bank or card issuer may apply a conversion rate and fees for which WinToFlight is not responsible.
Payment is processed by one of WinToFlight’s approved third-party payment providers. WinToFlight may use more than one provider and may allocate a given transaction to any of them; the provider handling a transaction is recorded against the order and will handle any subsequent operation relating to that order, including any refund.
An entry is only valid once payment has been successfully confirmed, at which point a ticket number is issued to the Participant and a confirmation email is sent. A payment that is declined, reversed, or not confirmed does not create a valid entry, regardless of any message displayed during checkout.
If a Participant is charged more than once for the same entry as a result of a technical error, the duplicate amount will be refunded upon request, via the original payment method and provider.
Each competition displays a closing date and time. Any entry attempt received after the closing date is invalid. The number of available tickets and the maximum number of tickets per person are set for each competition and shown on its dedicated page.
Each ticket grants access to a unique question of skill, judgement or knowledge, which the Participant must answer correctly for their ticket to be eligible for the prize. Only one attempt is permitted per ticket, unless otherwise stated on the competition page.
The winner is selected from among all Participants who answered the skill question correctly. Where a draw is required to determine a winner among several correct answers, it is carried out through an independent, certified random-draw platform, ensuring fairness and transparency. This draw among correct entries does not affect the competition’s classification as a skill-based competition under the law.
The winner is contacted by email and, where applicable, by phone, using the contact details associated with their account. If the winner does not respond within 14 days, a new draw may be held among the other eligible correct entries.
Before the prize is awarded, the winner must provide a valid government-issued photo ID, proof of address, and any other information reasonably required for legal compliance purposes.
WinToFlight reserves the right to refuse to award a prize in cases of suspected fraud, suspected money laundering, misrepresentation, or breach of these Conditions.
Each competition page specifies the prize description, its stated value, and any applicable restrictions.
The stated value of a prize is an estimate of its retail value at the date the competition opens, based on the prices then available from the relevant suppliers (airlines, hotels and other providers). Prices in the travel sector fluctuate, and the stated value is not a guaranteed monetary amount, a valuation of the prize at the date it is awarded, or a sum to which the winner is entitled in place of the prize.
The prize is not transferable to a third party before it is awarded, and is not convertible into cash.
Where the competition page expressly provides for it, a winner who does not wish to take the journey may instead request a travel credit, redeemable against travel booked through WinToFlight. The value, validity period and conditions of any such credit are stated on the competition page and are set independently of the prize’s stated value. The request must be made in writing within 14 days of the winner being notified; after that period, the prize is awarded as described.
If a prize, or a material component of it, becomes unavailable for reasons beyond WinToFlight’s control, WinToFlight will provide a substitute of broadly equivalent standard and value, or, where this is not reasonably possible, a travel credit of equivalent value. WinToFlight does not offer cash alternatives.
By accepting a prize, the winner agrees that WinToFlight may, free of charge and without further compensation, use their first name, photographs, videos and, where applicable, testimonials relating to their participation and their trip, for publicity and promotional purposes, including on the Site and on WinToFlight’s Instagram page and other social media accounts.
A winner who does not wish to be featured in this way may notify WinToFlight in writing before any such content is published; WinToFlight will use reasonable efforts to remove or refrain from publishing the content concerned, without this affecting the winner’s entitlement to the prize.
The trip must take place within the period stated on the competition page.
Exact travel dates are agreed between the winner and the WinToFlight team, subject to availability from suppliers (airlines, hotels).
In certain exceptional cases specified on the competition page, WinToFlight may impose fixed travel dates that cannot be changed.
WinToFlight is not responsible for visa refusals.
WinToFlight is not responsible for delays, cancellations or changes imposed by airlines, hotels, or any other third-party supplier.
The winner is solely responsible for ensuring that their travel documents (passport, visa) are valid.
WinToFlight accepts no liability whatsoever for anything that occurs during the course of the trip, including any accident, injury, illness, loss, theft, property damage, or any other incident arising during the provided services (flights, accommodation, transfers, activities). The winner, and anyone accompanying them, travel entirely at their own risk.
WinToFlight strongly recommends that the winner, and anyone accompanying them, take out suitable travel insurance if they wish to do so (covering, in particular, cancellation, repatriation, medical expenses and lost luggage) prior to departure. Taking out such insurance is entirely at the winner’s discretion and expense.
Participation in a competition is a service supplied immediately: the Participant obtains access to the skill question and their entry is registered as soon as payment is confirmed. By completing a purchase, the Participant expressly requests that this service begin immediately and acknowledges that, once their entry has been registered, they lose any right to cancel that would otherwise apply under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Accordingly, entries are final and non-refundable, except:
where WinToFlight cancels a competition before its closing date, in which case Participants receive a full refund of the entry fees paid;
where a competition is cancelled because a stated Minimum Threshold has not been reached, in accordance with Article 12;
where a proven technical error prevented a valid entry from being registered, or resulted in a duplicate charge;
where a refund is required by applicable law.
Refunds are issued via the original payment method and through the payment provider that processed the original transaction. WinToFlight is not responsible for delays attributable to the Participant’s bank or card issuer.
Nothing in this Article affects a Participant’s statutory rights.
Unless a different figure is stated on the relevant competition page, every competition is subject to a minimum entry threshold equal to 70% of the total number of tickets made available for that competition (the “Minimum Threshold”). The total number of tickets available is stated on each competition page, and the Minimum Threshold is derived from it automatically.
If the Minimum Threshold has not been reached by the closing date, WinToFlight will, before that date, either:
(a) extend the closing date by a further period of no more than 30 days. A competition may be extended in this way no more than twice. Any extension is announced on the competition page and notified by email to Participants who have already entered. Tickets already purchased remain valid, and any Participant who does not wish to remain entered may request a full refund of their entry fees within 14 days of the announcement; or
(b) cancel the competition, in which case all Participants receive a full refund of the entry fees paid, via the original payment method and provider, within 14 days of the announcement.
If the Minimum Threshold has still not been reached at the end of the final permitted extension, WinToFlight will either award the prize as described or cancel the competition and refund all Participants in full. WinToFlight will not reduce or substitute the advertised prize on the basis of the number of tickets sold.
Separately from the above, WinToFlight reserves the right to cancel or amend a competition in exceptional circumstances beyond its reasonable control. In the event of cancellation before the closing date, affected Participants receive a full refund.
The following conduct is prohibited:
Creating multiple accounts or impersonating another person.
Using bots, scripts or any automated means to purchase tickets or answer questions.
Fraudulent payments, including abusive chargebacks.
Any attempt to manipulate the competition or the payment system.
Any account involved in any of the above conduct may be suspended without refund and may be reported to the relevant authorities.
The winner is solely responsible for any tax liability arising from acceptance of the prize in their country of residence.
WinToFlight encourages responsible participation. The Site provides account management tools, including the ability to close an account or request a participation limit. Anyone who feels they have a problematic relationship with paid skill competitions is encouraged to contact specialist support services.
All content on the Site (text, visuals, trademarks, the WinToFlight logo, the structure of the Site) is protected by intellectual property law and remains the exclusive property of WinToFlight Ltd or its partners. Any unauthorised reproduction, extraction or reuse is prohibited.
Personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018. It is used solely for competition administration, identity verification, contacting winners, and, where consent has been given, sending marketing communications. A separate Privacy Policy, available on the Site, sets out these arrangements in detail.
WinToFlight shall not be liable for technical interruptions, payment processing errors beyond its control, force majeure events, or decisions made by regulatory authorities.
To the extent permitted by English law, WinToFlight’s maximum liability to a Participant is limited to the amount paid by that Participant for their entry. Nothing in these Conditions limits WinToFlight’s liability for death, personal injury caused by negligence, fraud, or any other matter for which liability cannot be limited under English law.
Any complaint relating to a competition must be submitted in writing to WinToFlight within 30 days of the relevant competition’s closing date, using the contact details set out in Article 22. WinToFlight will review and respond to any complaint within a reasonable time.
WinToFlight shall not be liable for any failure to perform its obligations resulting from an event beyond its reasonable control (natural disaster, conflict, government decision, major failure of a technical or payment service provider, etc.).
WinToFlight reserves the right to amend these Conditions at any time. Any material change will be notified to Participants by publication on the Site, indicating the date of the update. Competitions already underway at the time of an amendment remain governed by the conditions in force at the time the ticket was purchased.
These Conditions are governed by English law. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the courts of England and Wales.
